Descripción

This volume provides a comprehensive analysis of the legal status of fluvial increments within Roman legal thought and ancient practice, positioning the subject at the intersection of epigraphy, papyrology, and jurisprudence. Initiating with Magna Graecia's epigraphic tradition—specifically the Heraclea and Locri Epizefiri tables—the investigation underscores how Greek local practices surrounding alluvial accretions laid foundational precedents parallel to later Roman Digest doctrines. The study's core re-evaluates the Tabula Veleiatis, examining Trajanic land registers to elucidate how surveyor practices (agrimensura) and land categories (condiciones agrorum) dictated private ownership and occupation rights of riverine additions in centuriated territories. Furthermore, by analyzing periodic inundation zones (vada) in epigraphic documentation, the work traces the doctrinal evolution of riverbank definitions and dry riverbed allocations (alveus derelictus) from late Republican jurisprudence to the Severan era. Ultimately, an appendix on public river transitability offers fresh insights into the historical development and conceptual origin of predial servitudes.
